Your claim:
- When not rested for own assignment and not being placed on a vacant yard assignment ahead of extra employee (Must call CMS to express desire to place on an assignment)
- Claim basic day per Yard Schedule Item B – Section 12 (Daily Preference)
Required Documentation:
- Work History showing what time you were rested and placed on the mark-up board.
- Board snapshot showing what job you should have been assigned to when you were rested.
- Job History showing who was called for the assignment for which you stood.
- Snapshot of the extra board showing who was called for the train.
EXAMPLE:
Claiming a basic day for not being placed on vacant assignment (JOB-ID) at (CIRC-7 and BOARD) on (DATE and TIME) when I was not rested for my own assignment (JOB-ID) at (CIRC-7 and BOARD) due to working overtime the previous shift (DATE and TIME). This assignment was worked by (EMPLOYEE). This claim is fully supported by Yard Schedule Item B – Section 12 (Daily Preference) Part 4 which states A regular yardman worked more than 8 hours In a mark-up period who Is therefore unavailable for his scheduled assignment in the following mark-up period due to the Hours of Service Law will stand for service at expiration of his legal rest ahead of extra yardmen and will be permitted to mark up on a vacancy in the following mark-up period on which no yardman has been marked.
