Meal on Non-Interdivisional Service

(Dogcatching, Local Freight, etc)

The claim:

  •  - When called from road boards for other than Interdivisional Runs and denied a meal period as per Rule 28.

     - Make request for meal a period as far in advance as possible or as soon as it becomes apparent that you will be on-duty for more than 8 hours. 

  •  - Agreement and law boards allow for “reasonable amount of time”.

  •  - If denied a meal period or not allowed reasonable time for one, claim 130 mile basic day.

REQUIRED DOCUMENTATION:

- A copy of your federal tie-up.

 - Time that request for meal period was made to the Manager/Dispatcher. 

 - Manager/Dispatcher/Corridor name and time denied lunch.

CLAIM 130 MILE BASIC DAY FOR NOT BEING ALLOWED TO TAKE MEAL PERIOD AFTER 5 HOURS ON DUTY. WAS CALLED ON DUTY FOR  (JOB ID) AT ______ HRS ON (date) .  AT ______ HRS MADE REQUEST FOR MEAL PERIOD TO (DISPATCHER/MANAGER NAME).  REQUEST WAS DENIED AT _____HRS AND I WAS ORDERED TO CONTINUE WORKING FOR ENTIRE SHIFT WITHOUT BEING ALLOWED A MEAL PERIOD. CLAIM 130 MILE BASIC DAY FOR NOT BEING ALLOWED A MEAL PERIOD AS PER RULE 28.

NOT ALLOWED REASONABLE TIME:

CLAIM 130 MILE BASIC DAY FOR NOT BEING ALLOWED A REASONABLE AMOUNT OF TIME FOR MEAL PERIOD.  WAS CALLED ON DUTY FOR (JOB ID) AT ______HRS ON (DATE).  AT _____HRS WAS INSTRUCTED BY (DISPATCHER/MANAGER) TO TAKE ONLY ____MINUTES FOR LUNCH.  DUE TO THE UNIQUE CIRCUMSTANCES OF THE ASSIGNMENT, _____MINUTES WAS NOT AN  ADEQUATE NOR REASONABLE AMOUNT OF TIME AS ALLOWED PER RULE 28.  CLAIM 130 MILE BASIC DAY FOR NOT BEING ALLOWED A MEAL PERIOD AS PER RULE 28.
