Description: September 24, 2020 Mr. Luke Edington General Chairman - SMART TD 5990 SW 28“^ Street #F Topeka, KS 66614 Dear Mr. Edington, This is in reference to your letter dated June 30, 2020 providing 90 day advance notice to cancel the AWTS Agreement on Zone 100. Pursuant to discussions the parties have agreed to the following: 1. Not less than thirty (30) days after implementation of this Letter of Understanding the current minimum number of trainmen eligible for AWTS status may be adjusted to no less than 25% of the total number of furloughed employees within Zone 100, but will not be required to exceed 55 trainman. The Carrier may, at its discretion, adjust the number of available AWTS positions above 55 trainman if it so desires. 2. Every attempt shall be made to backfill open positions in an expedited manner. However, it is understood no claims will be filed or progressed regarding the application or interpretation of this Letter of Understanding. 3. The January 3, 2017 Zone 100 AWTS Agreement and this Letter of Understanding may be cancelled by either party by serving thirty (30) day written notice upon the other. It is understood all terms and conditions outlined in the Zone 100 AWTS Agreement dated January 3, 2017 remain unchanged unless specifically modified herein. Additionally, this Letter of Understanding will resolve the issue which prompted the June 20, 2020 notification and the cancellation is now considered rescinded.
