Gentlemen:

Your letter of September 21st, regarding agreement of April 2, 1941 between the Chicago, Burlington Sc. Quincy Railroad Company, Union Pacific Railroad Company, and Trustee of the Missouri Pacific Railroad Corporation in Nebraska, and the Brotherhood of Locomotive Engineers, Brotherhood of Locomotive Firemen and Enginemen, Brotherhood of Railroad Trainmen, and Order of Railway Conductors, covering switching at the Bomber Plant at Fort Crook, Nebraska.

As stated to you in our conference today, there is no provision in the agreement of April 2, 1941 which requires that crew or crews assigned as plant crews be restricted to performing service at the plant exclusively and work in connection therewith between the plant and designated point of beginning
assignment. However, in order to dispose of this case, I am agreeable to adoption of the following understanding:

During period the plant is in operation and served by Union Pacific crews, the crew or crews assigned to
perform the service between the plant and pick-up and set-out tracks will not be used in other yard service on any day on which 4 hours or more are consumed in serving the plant, computed from departure Gilmore Junction until return, thereto.

If- crew assigned to Bomber Plant is used in other yard service on days on which 4 hours or more are
consumed in serving the plant, they will be paid for other yard service on minute basis, with minimum of one hour at pro rata rate, in addition to the regular yard pay and without deduction therefrom for the time consumed in such service. All service performed by plant crew from time of going on duty until released from duty, in connection with plant operation, is not other yard service as referred to in this paragraph.

The foregoing will become effective October 15, 1943.

Each member of assigned plant crew will be allowed an arbitrary hour at pro rata rate on date plant crew was used to perform other yard service as herein referred to, in addition to compensation allowed during the period crew or crews were assigned as plant crews from May 1 5 , 1943 to October 14, 1943, inclusive.

It is agreed that payment on basis provided in this agreement constitutes full and complete settlement of all pending claims in connection with service performed by crews serving the Bomber Plant at Fort Crook, Nebraska.

Yours very truly,
/s/ F. C. Paulsen

ACCEPTED;
