LETTER OF UNDERSTANDING

SWITCHING LIMITS--LA GRANDE, OREGON

(common file number 1980. 20- 7)

The parties met on March 15, 1991, to review improvements which were agreed upon prior to implementation of the Agreements on extending switching limits at La Grande, Oregon.

This will confirm the understandings reached with regard to Agreements-between the Union Pacific and the United Transportation Union, and between the Union Pacific and the Brotherhood of Locomotive Engineers, dated May 24, 1990 and July 15, 1990, respectively.

The Carrier confirms it's obligation to provide for adequate maintenance, including snow removal, of the new staging areas and access thereto.

The parties confirm that required improvements to roadbed, walkways and access roads contemplated the staging of trains at locations previously identified. If future operational changes result in staging of trains at other locations within the limits, the Carrier agrees to conform to the requirements in the Agreements, with regards to improvements to the extended areas.

The Agreements, defined, will be implemented on March 31, 1991. Appropriate Carrier Representative. including Central Timekeeping and Crew Dispatching. will be notified of the effective date in order to minimize problems associated with implementation.

AGREEMENT

BETWEEN THE

UNION PACIFIC RAILROAD COMPANY
(WESTERN REGION - NAMPA SERVICE UNIT)

AND THE

UNITED TRANSPORTATION UNION (C, T, & E)

SWITCHING LIMITS - LA GRANDE, OREGON

In order to provide better and more efficient operation at LaGrande, which will ultimately result in better service to our customers, it is agreed the switching limits at LaGrande shall be extended under the following conditions:

1. The switching limits at LaGrande shall be extended Eastward to MP 295.3, commonly known as CP 295; and Westward to MP 285.7, commonly known as CP 286.

2. Final terminal delay points at LaGrande shall be moved Eastward and Westward and will be CP 295 for Westbound trains and CP 286 for Eastbound trains.

3. Trains which have departed the track upon which they were made and are on their road trip and still within the Terminal but are stopped for any reason, other than bad order cars or other incident over which the Carrier has no control (such as derailments, locomotive or train failures or Acts of God), shall again be considered as being on initial terminal delay time after being stopped for thirty minutes and continuing until the train again departs.

NOTE: This Agreement does not extend terminal delay payments to any class of service not presently receiving same.

4. The twenty (20) and twenty-five (25) mile limits for servicing customers and relieving trains stopped because of the provisions of the Hours of Service Law, will continue to be computed from the switching limits as they existed prior to this Agreement taking effect (MP 291.3 East and MP 287.86 West).

5. Trip mileages to and from LaGrande will be computed in the same manner as they were prior to the date of this Agreement, and will neither be shortened nor lengthened as a result of the expansion of the switching limits.

6. Crews operating in the West Pool, out of LaGrande only, will be allowed initial terminal delay after thirty minutes on duty in lieu of one hour and fifteen minutes .

7 . The Carrier will improve access corridors to trains to provide safe areas for mounting and dismounting trains in the extended areas .

This Agreement will become effective upon completion of the improvements referred to in Paragraph 7 , and will remain in effect until cancelled or modified under the provisions of the
Railway Act, as amended.
