UNION PACIFIC RAILROAD

October 28, 2004
550-30

Mr. D. L. Hazlett
General Chairman, UTU
5990 SW 28th Street, Ste. F
Topeka, KS 66614

Dear Sir:

This refers to our meeting on September 8, 2004 in Topeka, Kansas, wherein we discussed the ongoing Firemen-in-Training classes being held at Las Vegas, Nevada; Salt Lake City, Ogden and Milford, Utah.

Specifically, in an effort to allow the selected employees to attend Firemen-in Training classes at their home location without jeopardizing seniority, the parties signatory hereto agree the notice advertising for Firemen-in-Training positions will indicate the number of positions at each location and the anticipated training start date at each location. For the purpose of the Selection Process for Engine Service Promotion Agreement dated December 23, 1996, such handling is considered as a single class with seniority established from the oldest to the junior employee, all having the same engineer date.

EXAMPLE: Notice advertises 5 positions at Salt Lake starting on October I; 5 positions at Las Vegas starting on October I5; and, 5 positions at Milford starting on October 30. All positions will establish an April I engineer date in seniority order.

If the foregoing properly reflects your understanding and concurrence please sign below and return one copy to this office.

Yours truly,
/s/ Sharon F. Boone

I CONCUR
/s/ D L Hazlett
