#2212200283 (1940.35) between the UNION PACIFIC RAILROAD COMPANY and the UNITED TRANSPORTATION UNION For The Territory Eastern District Modification Of Schedule Rule 92(23) Salt Lake City Hub Zone 500 Strict Seniority At the request of the Organization, Carrier is agreeable to Modifying Rule 92 (23) for Trainmen within the Salt Lake City Hub, Zone 500 as follows: It Is Agreed: Section 1. Rule 92 (23) of the Schedule of Rules Agreement effective May 1, 1983, is hereby modified to read as follows: (23) A conductor who refuses to accept a regular pool assignment in freight service in preference to extra freight service will no longer surrender his/her seniority to the conductor who accepts the assignment. A Conductor assigned to a regular pool freight assignment must, when displaced or otherwise possessing a displacement right, exhaust his/her seniority rights as a conductor in pool freight service before displacing as a conductor or brakeman in regular assigned freight service or on combination, Conductor, or switchmen/brakemen extra boards. This does not restrict conductors assigned to regular pool freight assignments form making application bidding and being assigned to combination, Conductor, or Switchmen/ Brakemen extra boards or Conductor/ Brakemen positions in assigned freight service, seniority permitting. Section 2. If there are any provisions in other rules, agreements, understandings and/ or practices which are in conflict with the Agreement, such will be superseded by this Agreement. Section 3. This modification to Rule 92 (23) will become effective February 1, 2003 and will remain in effect unless either party serves a thirty (3 day advance written notice upon the other to cancel this agreement. Should this Agreement be canceled, the regular provisions of Rule 92 (23) will thereafter apply. Signed this 1st day of February ,2003.
