MODIFICATION OF RULE 58(h)
FIFTH AND SIXTH SENIORITY DISTRICT

IT IS AGREED:
1. Section (h) of Rule 58 of the Agreement between the United Transportation Union (C)&(T) and the Union Pacific Railroad-Eastern District, effective May 1, 1983 reads: "Combination switch and road runs will not be assigned under the provisions of this agreement out of
district terminals other than Beatrice, Gering and Sterling, except by agreement."

2. Consistent with the above-quoted sections, it is agreed a combination switch and road assignment will be established to work eastward out of Rawlins, Wyoming, effective immediately, and will operate in accordance with Rule 58 of the United Transportation Union (C)&(T) Schedule. Protection stipulations of Schedule Rule 94 apply to the actual assigned local, to be re-assigned on the annual bulletins.

3. The following shall apply to the operation of this assignment:

(a) Conductors' and brakemen's positions will be bulletined annually on June 1. The initial bulletin will cover the period to June 1, 1984. Conductors and brakemen under the annual bulletin will remain on the assignment for one year and will not be displaced by
senior conductors and/or brakemen during that period, except

(b) Employes forced to this assignment on a permanent basis may relinquish same per Rule 92(15) or they may bid on other assignments.

(c) The assignment shall not be abolished for a holiday; however, the assignment may be laid in.
(d) Rules 44 and 45 will not apply to successful applicants to this assignment. Temporary vacancies created by the regular assigned conductor and brakemen will be filled in accordance with Rule 44.

(e) Conductor and brakemen who are the successful applicants to the assignment shall be allowed to use the Rawlins lodging facility while securing private lodging up to 30 days.

4. This agreement will automatically terminate ten days after any of the parties serves written notice upon the others of desire to terminate it.
