Dear Sir:

 

In the negotiations which led to the ratification of the Memorandum of Agreement modifying Seniority Zone 100, questions arose regarding the obligations and rights of employees in the application of Section (e)(5)(a), and it was understood that the following would apply:

In the application of Section (e)(5)(a), an employee in road service who exercises his Zone 100 seniority rights under the provisions of Section (e)(4)(3) and bids on a bulletined road assignment on another prior seniority district, and subsequently loses the assignment through reduction in force or through no fault of his own, shall be governed by the Schedule Rules in effect on the "home district" of the assignment and will be subject to the provisions of Schedule Rule 92(17).

The employee will be required to remain on the prior road seniority district of the assignment for a period of 120 days from the date he was assigned unless he is the senior applicant for a bulletined assignment on another prior road seniority district or transfers to yard service under the provisions of Sections 5(a) and (b) of the Dual Rights Agreement.
