DISPLACEMENT RIGHTS (STRICT SENIORITY)
Description: MEMORANDUM OF AGREEMENT #2301209583 between UNION PACIFIC RAILROAD COMPANY for the territory EASTERN DISTRICT and the UNITED TRANSPORTATION UNION ****************************************************************************** ****************************************************************************** IT IS AGREED: Section 1. Rule 92(23) of the Schedule of Rules Agreement effective May 1, 1983, is hereby modified to read as follows: (23) A conductor who refuses to accept a regular pool assignment in freight service in preference to extra freight service will no longer surrender his/her seniority to the conductor who accepts the assignment. A conductor assigned to a regular pool freight assignment must, when displaced or otherwise possessing a displacement right, exhaust his/her seniority rights as a conductor in pool freight service before displacing as a conductor or brakeman in regular assigned freight service or on combination, conductor, or switchmanl/brakeman extra boards. This does not restrict conductors assigned to regular pool freight assignments from making application/bidding and being assigned to combination, conductor, or switchman/brakeman extra boards or conductor/brakemen positions in assigned freight service, seniority permitting. Section 2. If there are any provisions in other rules, agreements, understandings and/or practices which are in conflict with this Agreement, such will be superceded by this Agreement. Section 3. This modification to Rule 92(23) will become effective February 1, 1995 and will remain in effect unless otherwise modified or cancelled in accordance with the provisions of the Railway Labor Act.
