RULE 45 -

SELF - PROPELLED MACHINES

(a) Road Service: The following shall govern the manning of self - propelled vehicles or machines by train service employees (conductors and brakemen) used in maintenance, repair, construction or inspection work:

(1)  A conductor will be employed on on - rail self - propelled vehicles or machines when operating in main line territory, provided such machines are equipped with a drawbar and are operating under train orders.

NOTE 1. Self - propelled machines for the purpose of this paragraph means such equipment operated on rails.

NOTE 2: Drawbar means a device capable of being used in moving standard freight cars.

NOTE 3: Main line territory means main line and branch lines in road territory outside of switching limits but not spurs or the like.

NOTE 4:The term "train orders" is used in the vernacular of trainmen as defined in the Operating Book of Rules.

(2) Conductors In this service, who are not furnished brakemen, will be paid the local freight rate, applicable to the district, and work train conditions, and when brakemen are furnished, crew will be paid work train rates and conditions. Conductor - pilots used in this service, from tie - up point to tie - up point, when no work service is performed en route, will be paid through freight rates and conditions.

(b) Yard Service: A yard conductor (foreman) will be employed on on - rail self - propelled vehicles or machines operating within general switching limits provided such machines have sufficient power to move freight cars; and, if more than two cars are handled at any one time, exclusive of idler car, a yard brakeman (helper) will be employed.

This provision will not apply to the operation of self - propelled vehicles or machines in confined areas such as shop tracks, supply areas, tie yards and so forth.

(c) Separation of Road and Yard Service: On self - propelled roadway machines, if day's work is inside switching limit, in yards where yard crews are employed, a yard foreman will be used as pilot. If self - propelled roadway machines originate in road service and then come into the yard to finish day's work - , or originate in yard and finish day's work in road service; or originate in road or yard service and finish in the service where started, under circumstances where the greater portion of the day's work is in road service, a conductor - pilot will be used.

(d) Except as specifically prescribed herein, operating employees need not be used on self - propelled vehicles or machines.

NOTE: Self - Propelled Machines Defined: Self - propelled machines as referred to herein do not include machines used by track and bridgemen in connection with their work that can be lifted from track at setoff points.
